- On the acceptance of this offer an agency agreement shall come about, on the basis of which the recipient shall be obliged to pay Bonheur Immobilien commission if it purchases, leases or rents the property.
- Unless otherwise agreed in writing, the commission shall be 6% plus the legal rate of VAT of the purchase price as recorded by a notary. In the case of a rental relationship, this shall be the cost of between one and three months rent without heating, depending on the agreement.
- The commission shall be due for payment on signing the purchase or rental agreement.
- The offer is intended exclusively for the recipient. If it is passed to a third party, the recipient shall be liable for the commission of the negotiating agent.
- If the property identified by us is known to the recipient, then he/she shall be obliged to inform us of this immediately and prove this on request.
- All of the information in the property details comes from the owners or other third parties and we accept no liability for their accuracy or completeness.
- Our offers and information may only be passed to third parties with our express written permission. Should an agreement come about due to unauthorised transfer of information, then the commission must be paid to us in full.
- Sub-agreements must be made in writing. The place of fulfilment and the court of jurisdiction is Berlin.
- Partial invalidity: Should some regulations be or become invalid or unworkable, then the validity of the other regulations shall remain unaffected. Legal regulations shall apply analogously in the place of any unworkable regulations.
